COURT HOUSE– The Middle Township Police Department has completed its investigation of a motor vehicle crash that occurred on Jan 26. involving a Middle Township Ambulance, according to a press release.
After consultation with the Cape May County Prosecutors Office, Middle Township Police investigators have charged the ambulance driver, Joseph Sims Jr., with Careless Driving, for failing to exercise due caution when he chose to drive the ambulance after receiving potentially grave news about the welfare of his parents, the release said.
The investigation revealed that Joseph Sims Jr. did not respond in an official capacity to the fire at his parent’s home in Erma, where his father, Joseph Sims, had subsequently passed. The ambulance was traveling at speeds moderately above the speed limit, but not unreasonable speed for an emergency vehicle utilizing lights and sirens in an emergency response.
The second driver, Alyn Toth, has been also cited for Careless Driving for failing to exercise due caution when she reentered the roadway to make a left turn onto Joffre Ave. from the right shoulder. Ms. Toth had pulled to the right shoulder of U.S. 9 southbound for an emergency vehicle that had just passed.
The case remains under review at the Cape May County Prosecutors Office. After the Prosecutors Office review, the charges will either be heard in Superior Court or a local Municipal Court.
The ambulance driver, Joseph Sims Jr., is on administrative leave pending the outcome of the investigation and an administrative investigation through the Township of Middle.
