Commissioner Can Keep Seat

WILDWOOD — Superior Court Judge Valerie Armstrong upheld a decision Monday April 20 that allowed Wildwood Commissioner Gary DeMarzo to keep his seat, while on leave as a Wildwood Police Officer.
Mayor Ernie Troiano Jr. and Commissioner Bill Davenport had asked Armstrong to find DeMarzo in violation of retired Superior Court Judge Visalli’s order, which said DeMarzo could serve as a commissioner as long as he took an unpaid leave of absence and recused himself from dealing with a host of issues that would present a conflict.
In the most recent decision, Armstrong warned DeMarzo and the city about what might happen should she be asked to revisit the matter.
“DeMarzo is on notice that should he continue on this same path, this court will take very seriously any future motion filed by the city seeking relief from the terms of Judge (Joseph) Visalli’s order currently permitting DeMarzo to serve as commissioner while remaining on an unpaid leave of absence from the Police Department. Likewise, the city is on notice that the court will carefully scrutinize any such motion for reconsideration to ensure there is merit to it,” Armstrong wrote.
Armstrong added that she would not be on call to settle disputes between DeMarzo and the rest of the City Commission.
