Sunday Breakfast Interrupted by Deck Collapse

WILDWOOD — Four people having breakfast had to make a run for it Sept. 2 when the front deck of their condo began to collapse.

According to reports, Dexter Silimperi, owner of the 523 West Montgomery Avenue property said he heard a crack shortly before the deck began to fall. He said the repair crew told him the deck was framed incorrectly and the wood used was unfinished and had rotted.

Unfortunately, Silimperi said his troubles with the condo also included a leak in the roof and a garage door collapse.

City inspectors were out on the scene yesterday morning. They will also be checking additional homes on the block for similar issues.

Construction Official Glenn Franzoi told the Herald columns on all the deck fronts of the block were to be exposed for a complete inspection. A design professional, he said, will have to be brought in to design a fix.

Then, according to Franzio, the construction office can review those designs and the proper permits can be issued.

Franzoi added there may also be issues with the rear decks, but the current cause of concern is the front porch decks.

Currently residents are still living in the units.

“The buildings can still be occupied,” Franzoi said. “We’re just telling people not to go out on the decks.”

Has any group legal action begun against Rubin, Rossner and/or Oceanside? If so, how can I join?

CLARK construction projects Delano by the Sea (407 E. Monterey in Wildwood Crest) andHawaii Kai (7405 Ocean in Wildwood Crest) are currently being marketed. Buyers should be extremely war of these properties, given the history of CLARK Constuction and their failure to rectify problems. A thorough engineering inspection and a major ($50-100K) price concession (to deal with the likelihood of financing post-construction repairs) would be prudent moves by prospective buyers. Buyer Beware. Do NOT expect any assistance by your real estate agent, particularly if you have made the mistake of selecting Oceanside Realty.

We have a condo built by Rosner for Clark Assoc. and was purchased through Oceanside. Our first few days were a living hell. We had raw sewage back up into our tub, had a water leak, a main pipe leak(destroying landscaping and sidewalks that were then patched), and the best a gas leak. We've not had one item on our checklist fixed, are missing screens, have had siding blow off, very little heat in our lower level, and now are concerned about our deck. So much for sunshine and happiness in North Wildwood.

What should we do if we have a condo built by Clark? Lee Rossner needs to take responsibilty for his work. Especially now when serious injuries or fatalities could occur.

Rossner should be in prison right now. He's ignoring all of the other problems he's created at other properties. He whines and moans that he hasn't been paid and tells property owners not to bother him. What a scumbag. Where did pride go in this country???

BUT
Why does he and the city of Wildwood allow CLARK construction and Lee Rossner to continue other projects on the island when "completed" condos less than 2 years old are literally falling down? CLARK Construction and Lee Rossner have been unwilling to address problems at multiple condo developments. A "take-charge guy" would halt work at ongoing pojects by Lee Rossner and guide him toward fixing the festering problems in "completed" developments before decks at THOSE places fall off.

BUT
why, then, is Lee Rossner and CLARK construction still an active builder on the island when their 2-year-old buildings have trouble hoding onto their decks. At the very least, active projects by Lee Rossner should be placed on hold while he and the developers address previous buildings put up in a shoddy manner. Perhaps the "take-charge guy" could provide Mr. Rossner some guidance.

Lee Rossner was the builder and Marvin Rubin was the developer. Oceanside does nothing to help the problem. Don't do business with any of them. The mayor has been a take charge guy, though. He's why you should still have faith and invest in Wildwood.

My CLARK Construction-built condo was a top-to-bottom fiasco.
Let me give you an example of a small problem which CLARK Construction, the developer SVS1, and Oceanside Realty collaborated in making into a major headache which took over 6 months to resolve.
The above entities could not agree upon how to number units in the building. In fact, my unit number was changed on the morning of the day of closing. No big deal, right? Except that Oceanside Realty assigned me mismatched unit numbers for my utility bills. Rather than correct this problem ASAP as any reliable/competent company might, CLARK construction, SVS1, and Oceanside Realty propogated this unit number mismatching throughout the building as units were sold. So that I was receiving bills for the units of other condos. Add foreclosure problems to this mix and see what happens. AND ON TOP OF THIS, the subcontractor work (both plumbing and electrical wiring) was essentially spaghetti------meters were mislabeled for every unit in the building.
Reaction by CLARK construction, SVS1, and Oceanside? Just another day in Wildwood.

This is not surprising.
The builder, CLARK Associates, also built the condo I own. There are similar problems with roof leaking, code violations, garage door failures, etc, etc, just not the dramatic pictures in the newspaper (the deck falling off). Our homeowners assn has been unable to get the builder or the developer SVS1 to step up to the plate and fix the problems. THAT'S the thing that stands out in both projects-----the builder and developer, aided by the realtor Oceanside, refuse to take responsibility.
Who would ever buy a condo in Wildwood???
