COURT HOUSE-- On Saturday, Jan 2, Middle Township Police received a call of a pedestrian motor vehicle accident in front of TJ Maxx in Cape May Court House. When officers arrived, it was discovered that the injured pedestrian was off duty Middle Township Police Corporal Fran Fiore.

Cpl. Fiore was transported to Cape Regional Medical Center with serious leg injuries from being pinned between the vehicles.

The investigation revealed that Cpl. Fiore was parked in front of TJ Maxx on the Route 9 side and was standing behind his vehicle with the hatch open, loading his vehicle.

It was brought to the Herald's attention that both vehicles were in a fire zone in front of the store at the time of the accident.

A blue Dodge 1500 pickup truck driven by Edward R. Williams, 51, of the Villas backed into Cpl. Fiore and then Cpl. Fiore's minivan, pinning Fiore’s legs between the vehicles. Williams then pulled his vehicle forward and parked.

A concerned citizen took the keys from Williams, at Cpl. Fiore’s request.

Edward Williams was subsequently arrested for DWI and transported to police headquarters. He was charged with DWI and Aggravated Assault by Auto 3 degree. Bail was set at $50,000. 10% and he was transported to Cape May County Correctional Center.

Sergeant Pat Conte is handling the investigation.

Idiots.

For those who actually care; the officer was released from the hospital on monday and is home resting, thankfully he did not need surgery.

Tue, 01/05/2010 - 7:00pm - Posted by: Vader

LMFAO!!!!!!!!! What a toolbag you are. Keep driving your widdle twuck and moving real furniture loser. Again LMFAO!!!! Bahhhhhhhhhhhhhhhh Haaaaaaaaaaaaaaaaa!!!!!

Tue, 01/05/2010 - 7:07pm - Posted by: imgonnafishing

Gee vader, bla bla bla. You're probably 1 of those do dos that park right in front of a store cause you're to lazy to walk a short distant to the real parking lot where you should really park. You sure can twist the words huh? Twisted it was twisted does. Try walking a little farther. Yeap, Real Truck Driver and would run cicles around you backward blind folded. Proud of it.

Tue, 01/05/2010 - 2:21pm - Posted by: Vader

Wooooo Hooooo! So you were a real furniture delivery guy and you unloaded real furniture. Wow! Now I am impressed. You do have a truck driver mouth though. Listen to me clearly r-e-t-a-r-t! He was parked in the lot. His wife went to get the car and pulled it up front to load it which would have taken a couple minutes tops. Everyone knows that if you pull into a fire zone for loading or unloading, you are not going to be hastled. They don't want people parking there and leaving their vehicle because if there is a fire, and the owner of the vehicle can't be found, they can't move the car quickly. Are you with me dumb dumb? If someone is in their car, they can easily drive away if there is an issue. If any cop gave you a problem, it was because you were unloading REAL furniture which should require you to be at a REAL loading area for commercial vehicles only. If any cop gave anyone else a problem for doing what this guy and his wife did then the cop was an @$$hole just like Imgonnafishing.
In case you forgot i-d-i-o-t, here is what you wrote:
WOW, Parked in a NO Parking or Standing FIRE ZONE. Uphold the laws please.
If that's not taking a shot at a cop, then Obama is a great president. But you are too s-t-u-p-i-d to realize that. Now you run along now. Maybe go fishing or something tool bag. LMFAO!!!!

Tue, 01/05/2010 - 9:07am - Posted by: yankie44

One time we were at the Goshen rec, and a middle officer was watching her kid play soccer, Had the police car parked in the handicap zone!!!

Mon, 01/04/2010 - 11:26pm - Posted by: the_truth

Wow. The fact that this man was a cop has absolutely nothing to do with the fact that the guy was charged. It's amazing how ignorant people in CMC are. But, on a side note, what a great way to close the budget gap in this state... start writing tickets to everyone who parks in the fire lanes at shopping centers.

Mon, 01/04/2010 - 10:52pm - Posted by: The Dark Knight

Seriously you people are missing the picture here. It was a no parking fire lane ok, the guy was hit by a suspected drunk driver.Driver was arrested on such suspicion and charged with agg. assault.Would things have been done different if this wasn't an off duty officer? answer no! Things would have been done exactly the same. Glad the officer is going to be ok! The driver will be given his day in court just like everyone else.

Mon, 01/04/2010 - 10:11pm - Posted by: MiddleTwpResident

All this talk of being parked in the fire zone, does TJ Maxx fall under the twp ordinance of "No Parking in the Firezone"? Because it's only specific parking lots that opted to be part of that ordinance. SOOOOO maybe there is no law preventing any parking there

Mon, 01/04/2010 - 9:11pm - Posted by: imgonnafishing

Hey @$$ Hole, I drove tractor trailers and had to unload real furniture and always got moved along, not a piece of maybe a 4X8 carpet, oh wait a minute, maybe it was a full living room size 1. I didn't coment on hating police @$$wipe and I hope the drunk gets whats coming to him. STILL, IT"S A FIRE ZONE, NO STOPPING OR STANDING PERIOD...

Mon, 01/04/2010 - 8:06pm - Posted by: MiddleTwpResident

Oh No! Parked in the LOADING ZONE while LOADING a large piece of carpet. He should be executed........the drunk was just taking the law in his own hands

Mon, 01/04/2010 - 7:11pm - Posted by: Vader

Can't you read imgonnafishing!? He was loading a piece of furniture that he bought in the store! They allow you to do that! The store and the police! Stop hating on the police you POS! Another s-t-u-p-i-d @$$!!!

Mon, 01/04/2010 - 7:06pm - Posted by: imgonnafishing

WOW, Parked in a NO Parking or Standing FIRE ZONE. Uphold the laws please.

smiley2248.....his BAC was .20% almost 3 times the limit........guilty

Tue, 01/05/2010 - 2:31am - Posted by: emkaydist

waaaaaaaaaaaaaaaaaay funny. I would pay to see the full surveillance tape of this one.

I wouldn't be surprised if the thousands of CMCounty drunks start slamming into the police cruisers every weekend. The problem is the NJ taxes on the booze. When is the Cape May moonshine gonna start being distributed more freely?

Middle gets a ton of calls daily and does a great job responding to those in need. They should be commended more for their valor and courage.

Is it possible that this was intentional? Not that I am saying Middle is full of dirty, lazy cops or anything. It just seems like a complete disregard for the law to do the things that these drivers keep doing. This is such a slap in the face. I am amazed at the ignorance.

and Rossi......................you're just pissed because I beat your sorry a$$ in court more than once. Get a new job, you weak piece of SH1t.

Mon, 01/04/2010 - 11:44am - Posted by: smily2248

Now, here are the facts: He is innocent until proven guilty. This man is not really a heavy drinker (no saying one has to be in order to DWI), however, let the courts figure it out. I have not seen anywhere that his blood alcohol content was above legal limit. Normally the papers state "person was charged with twice the legal limit" etc. Leave the guy alone. Most of these posts don't ever relate to this particular person / posts. He was a cop, any way to rig the testing will be done in his favor.

Mon, 01/04/2010 - 8:12am - Posted by: yankie44

I am not foolish, The guy that hit me was drunk. My lawyer and I took him to court and he got what he deserved. He knew the police and got away a little easier than he should have. At least I got paid dearly for what he did. I am just saying, it pays to know or be a police officer.

Mon, 01/04/2010 - 7:17am - Posted by: ratboy2

what ever happened to the officer friend that helped doug whitten get home that night he was dui and hit a nj transit bus, there both still employed by LTPD !

Mon, 01/04/2010 - 12:39am - Posted by: Vader

Couldn't have said it any better Deagles! Yankee44 realized that he/she was foolish and totally wrong which is why they deleted their posts. When it comes to cops, people want to assume way too soon. They don't realize that in todays policing, you can't get away with helping out a friend. If caught, you'll get fired on the spot.

Sun, 01/03/2010 - 10:01pm - Posted by: Deagles

"Im just saying it does pay to be a cop or know one. The guy that hit me was drunk, left the scene and called his police friends to get away with it at the time."

Way to backpedal. I highly doubt that's what happened. He was charged with what he legally could be charged with. I doubt the cops said "quick leave the scene." And what does that have to do with anything you initially said or implied? What you originally said was the reason the cops were charging the middle twps assailant the way they were was because he was a cop. Then you were chumped out and proven wrong so you backpedaled and tried to save face by deleting posts and doing your best to only acknowledge the little points you felt were legit(which weren't anyway).

In this case if the subject had left he would have been charged the same, instead of dwi it would have been leaving the scene, failure to report, and agg assault by auto. Even worse you probably shared your "story" with lots of other friends who believed you and then had anti-police sentiment instead of researching the truth you made assumptions.

Terrible.

I'm not trying to completely flame you, but it's this type of commenting that people end up believing rather than researching fact and paint law enforcement in a negative stereotype and making their job even more difficult.

Sun, 01/03/2010 - 9:22pm - Posted by: mommomkip

someone very close to me was a passenger in a car driven by a drunk driver. my relative was seriously injured and the driver was charged with assault by auto and spent time in jail. my point is this person isnt charged with assault by auto just because it was an off duty police officer that was injured. this law applies to anyone that injures someone else, no matter who it is, if their drunk driving.

Sun, 01/03/2010 - 9:21pm - Posted by: yankie44

Im just saying it does pay to be a cop or know one. The guy that hit me was drunk, left the scene and called his police friends to get away with it at the time.

Sun, 01/03/2010 - 3:49pm - Posted by: Deagles

"I hear you at what you said about driving and being caught, the three people know he was drunk. Himself and two cops.Hes the town drunk. Still out there drinking and driving at that. Just hope he doesn't hurt anyone else. But it does pay to be a cop or know one..."

Very good, but think about this. IN COURT Law enforcement who are trained and certified have lost dwi cases. What makes you think just because three untrained civilian witnesses previously saw him it would hold up in court. He wasn't charged for DWI after leaving the scene because the police simply COULDN'T legally, not because he knew the cops. Sounds like in lieu of DWI (which wouldn't have held in court given the legal circumstances) he got other charges. Sounds like it worked out and the cops didn't help him.

Once again stop being jaded. Be glad that a drunk driver was caught and charged after injuring a decent human being(who just happens to make his living as police officer) instead of crying afoul over the only reason he was charged was because the victim was a cop.

Sun, 01/03/2010 - 3:40pm - Posted by: Vader

Wow!!! It's so nice how s-t-u-p-i-d people bash cops on here for no good reason. This poor guy was doing nothing wrong, he gets hit by a drunk driver, and he is the one being crucified. Are you kidding me!? You people are ignorant fools! Bye the way, if a drunk driver hits a pedestrian, it's a charge of agg. assault due to the injuries not because he was a cop you ***! Go read a book and educate yourself before running your mouth. After all.....it's better to remain silent and let people think you are s-t-u-p-i-d, then to open your mouth and remove all doubt.

Sun, 01/03/2010 - 3:35pm - Posted by: hogryder

yankie44: OK, I'M confused! First you say he was let go and not ticketed, then you say, "Thank god in the end, he got found 100% found guilty." Guilty of what? How could he be found guilty of anything if he was let go and not ticketed? Just what does ANY of this have to do with someone getting pinned between two vehicles by a drunk driver? You're saying that if Corporal Fiore was a civilian the police would have just let they guy go with no charges? Get a grip.

Sun, 01/03/2010 - 9:24pm - Posted by: yankie44

!!!

Sun, 01/03/2010 - 3:10pm - Posted by: Deagles

yankie, it sounds like maybe it was a hit and run. If that's the case it is VERY hard to get a DWI if they leave the scene prior to the police arrival. Low-class attorney's present the argument that "he wasn't drunk when he hit, he was sober got nervous fled and then drank once he got home." That has nothing to do with the cops, it has everything to do with the Judicial process. It would be a groundless charge to give a man DWI after he left the scene and was arrested later. It's not the cops fault, clearly they would like to be able to charge, but their hands are tied by the limits of the law. Once again misplaced blame. So now because you feel wronged that the person in your accident didn't get a DWI you feel that another HUMAN BEING (who just so happens to be a cop) shouldn't have his assailant charged to the fullest extent of the law? If anything you should be supporting that the police are "doing all of this"(which is exactly what they do anyway).

Sun, 01/03/2010 - 3:08pm - Posted by: Keep Right Pass Left

Yankee, there is a reason your "drunk driver" was not charged. He can not be charged with DUI unless he was found operating a vehicle while intoxicated. If he made it home, or anywhere else, the police can not prove that he was drunk at the time of the accident. He could easily say that he was drinking AFTER the crash. Sorry, but there was no conspiracy to save a drunk driver that hit you and your horse. And how, exactly, were the police at fault for him drinking???

Outlaw1984 Get a life! He was behind the wheel DRUNK. Suppose a child was standing behind the car with him? This man was seriously injured. So he's a cop, believe me the guy still would of been charged. Thank God he didn't flee the scene and kill someone. He had no business on the road. What the hell is wrong with Cape May County? Three major drunk driving accidents in one weekend? Find a better way to utilize your time.

Sun, 01/03/2010 - 1:44pm - Posted by: Deagles

Yaknie44, perhaps the person was "let go" because he wasn't drunk. Just that you were hit doesn't automatically make them drunk. What training did you undergo to test intoxicated drivers?

Get a ticket for being in the firezone? If any civilian was in the firezone and hit they would not be ticketed. Get over yourself. Your disdain for police shouldn't cloud the reality of the situation.

THE ONLY reason the driver was charged with DWI and Assault was because the victim was a cop? You must be out of your mind. Where is the basis of that? Go review NJ court cases over the past decade. It is on par that when their is a dwi resulting in injury to a vicitim(ANY VICTIM) the charges are what was in this case. Why should they NOT charge the driver that way? Just because hes a cop the accused should get less?

Only in Cape May County are people so vain and take on the woo is me ideal. This driver didn't know he was a cop. It could have been any one of you or your children there that he was hitting, and yet here you are practically condemning the officer and championing the bad guy for your own personal anti police agenda. Pathetic.

Sun, 01/03/2010 - 12:35pm - Posted by: uptwpfire

Who cares if he is a cop. What does that have to do with this story? He wasn't working or on duty. If he worked at McDonald, would they post "off duty burger maker seriously injured by drunk driver"? The fact is, he was injured by a drunk driver. That is the news.

Sun, 01/03/2010 - 12:03pm - Posted by: cmcgirl

Before you idiots start running your mouths know the facts. The cop was loading in a PIECE OF FURNITURE......you can pull up to pick up large items like that....the drunk was just parked there ILLEGALLY waiting for someone to come out of the store. I was there....the cop's wife went to the parking spot and drove the car up to load the purchase in. Get a life people...a man was SERIOUSLY hurt here BY A DRUNK DRIVER. When are people going to realize they SHOULD NOT DRIVE IF THEY ARE DRUNK. It i sad to me that you are all finding fault with the innocent bystandard. I am sending prayers out to the police officer for a speedy recovery. Even with the situation he handled himself professionally.

Sun, 01/03/2010 - 11:41am - Posted by: templerob

What is wrong with some of you! Cops are human too. Drunk Drivers should rot in hell for ever without Parole ! and no I am not a police officer!! G-dspeed to Fran!

Sun, 01/03/2010 - 11:16am - Posted by: outlaw1984

you are right the DUI would have been issued but you know damn well that the only reason they charged him with Aggravated Assault is because it was a cop that got hit.....

outlaw1984, you can't say you have never parked in the fire zone to load or unload things or people? Unreal what people say on here. Officer Fiore our thoughts and prayers are with you.

Sun, 01/03/2010 - 7:18am - Posted by: Ilovethisstuff

why wouldnt have they charged him the same? dui is a dui.... I don't know about you but i park in the fire zone if you can call it parking i guess when picking up someone coming out of the store or or dropping them off I've never been ticketed and honeslty who cares if the cop got a ticket he was pinned against his own car by a drunk driver I just hope he's ok

Sun, 01/03/2010 - 5:19am - Posted by: JerseyDevil

Yeah you're right outlaw, if YOU had been hit, they wouldn't have charged a drunk driver.[/sarcasm] Get a clue. It could have been you that was hit, be glad it wasn't and move on.

Sun, 01/03/2010 - 3:40am - Posted by: outlaw1984

Ya know what is funny i wonder if the cop got a ticket for parking in the fire zone and if that was me that got backed into i know they wouldn't have charged the guy the same way...
