OCEAN CITY POLICE RELEASE:
OCEAN CITY — On July 7 at approximately 3 p.m., the Ocean City Police received a report from the Ocean City Beach Patrol about a loud disorderly group on the 34th Street Beach. When officers arrived, they located a group of individuals who had been consuming alcohol on the beach and were using foul language.
Officers approached the group and were immediately confronted by the group who denied their actions and refused to leave the beach. This confrontation resulted in the arrest of Justin Nespoli who is 20 years old from Pennsville, NJ. He was subsequently charged with disorderly conduct and the consumption of alcohol on the beach.
This incident adds credibility of many reports received by the Department, over the past week, relating to the illegal consumption of alcohol on City beaches.
Arrested: Justin Nespoli, Age 20, Pennsville, NJ
Charges: 1) Disorderly Conduct 2C:33-2
2) Public Consumption of Alcohol C/O:87-17 sec18-2.7(f)
In response to these complaints, the police department has asked members of the Ocean City Beach Patrol and Ocean City Beach Fee Inspectors to call police if they spot persons consuming alcohol on City beaches. The Ocean City Police Department would like to remind all persons enjoying our beaches that the possession and/or consumption of alcoholic beverages are prohibited by City Ordinance 87-17 sec: 18-2.7(f). The beach and ocean contain many hidden hazards that can become more threatening after a person has consumed alcohol.
It is also important to remember that the beach is there for the enjoyment of everyone and the consumption of alcoholic beverages may affect your neighbor’s right to enjoy the beach in a family friendly atmosphere. Officers will be patrolling the beaches to enforce this and other City Ordinances that affect a person’s right to enjoy the beach.

A underage drinking charge can have serious consequences to a persons future I'm happy they only hit him with the local ordinances. Hopefully between the police and his parents busting his @ss he will be scared enough not to drink till its in a legal way. Underage kids drink no reason to ruin his life.

I assure you I'm not. I have no criminal record, never even had a parking ticket, or any ticket for that matter.
I lived in Tuckahoe all my life, have a wife, 2 children, and a dog.

Why not charge him with the local ordinance(public consumption of alcohol), as well as the STATE LAW of Underage consumption of alcohol? This is what should have been done. The ABC works so hard to keep underage kids out of bars in other shore towns, why is this kid getting a "pass" when it comes to drinking illegally in public?
Has it suddenly become not illegal to drink alcohol at the age of 20 years old?
If so let me call up my son's friends and let them know they can drink in Ocean City, and as long as they keep it contained to private property they will not get in trouble.

He should have also been charged with:
NJSA-2C:33-15-Consumption or Possession of Alcohol by Persons Under 21.
It is a criminal offense in the State of New Jersey (2C:33-15) for any person under the legal age to purchase alcoholic beverages who knowingly possesses without legal authority or who knowingly consumes any alcoholic beverage in any school, public conveyance, public place, or public assembly, or motor vehicle.
A fine not less than $500.00. Suspension or postponement of the driving privilege for 6 months if the offense is committed in a motor vehicle. There is no indication in the law that a diversion program is available for offenders.
