Judge Tourison's Discipline Hearing Set for Dec. 10

NEW BRUNSWICK — A local municipal court judge charged with drunk driving must face a disciplinary panel to find out his fate.

On Dec. 2, the Advisory Committee on Judicial Conduct announced it will hold a formal hearing in In the matter of Municipal Court Judge Peter M. Tourison at 10:30 a.m. on Wednesday, Dec. 10, in Room 230, at the New Jersey Law Center, 1 Constitution Square, New Brunswick.

A formal complaint was filed in this matter by the Advisory Committee on Judicial Conduct on Oct. 27.

The complaint details the following:

On June 25 Judge Peter Tourison, who presided over the municipal courts in Cape May, Stone Harbor and Middle Township, pled guilty to a charge of DWI before Judge David Krell in the Penns Grove Municipal Court.

Tourison lost his driver’s license for 90 days and was charged over $700 in fines and surcharges.

The incident occurred on March 27 when Tourison was observed driving his BMW in an erratic fashion before striking another vehicle in the North Cape May Wawa parking lot.

Tourison failed a field sobriety test and was taken to Lower Township Police Department.

While being processed, Tourison repeatedly applied lip balm and held a penny in his mouth in an effort to fool a blood alcohol content (BAC) test, according to the complaint. His test revealed a BAC of .08, the legal limit in New Jersey.

In its complaint, the Ethics Committee alleges Tourison violated three canons of the state judicial code of conduct:

• Canon 1, which requires judges to observe high standards of conduct
• Canon 2A, which requires judges to respect and comply with the law
• Canon 5A(2), which requires judges to conduct all of their extra-judicial activities so that they do not demean the judicial office

Tourison’s actions also broke court rules that constituted misconduct in office and conduct prejudicial to the administration of justice, the complaint stated.

Tourison's filed an answer to the complaint on Dec. 2.

"The respondent in this matter will not challenge the allegations set forth in the complaint, with the full understanding that the committee will deem the allegations as admitted and proved by clear and convincing evidence," the answer stated.

If the charges against him have been proven by clear and convincing evidence during a formal hearing, Tourison faces public reprimand, censure, suspension, or removal from the bench by the Supreme Court, according to judicial conduct rules.

Based on previous decisions, however, it seems unlikely that Tourison will be removed.

Since the ACJC was formed in 1974, 11 state judges have been disciplined for similar of-fences with eight receiving public reprimands and three receiving censure.

why do judges only get 90 days if everone gets 120 days lost of license you got to be a judges or a cop to drive drunk in this county

On Judge Tourison maybe everyone should apolgize and get a slap on their risk long as he dos't hit somebody child or hurt a family member. He should of went to AA meetings and he dons'nt deserve to be on the bench until he completes his counciling. he should do drug court,family court, or traffic court period. we all do stupid things when were drunk but still thats no excuse. Our tax dollars dont pay for him to say im sorry.Were the mothers against drunk driving now.

Tourison should be held accountable for his actions. Hes drinking more now then ever being that his job is in jeapordy. You should get rid of judge Tourison. Once an alcoholic always an alcoholic. Hes on the bench making discions.they should be over tured..get rid of him. Or his gavel will come take everybody else out.

he shouldn't be on the bench anymore period because he shouldn't do any alchohol or drug or family cases because hes under the influience and it's a discrase to the judges and the bench.He shouldn't be aloud to rule on anything until he is delt with the the supreme court system after his hearing. Anything he does she be thrown out of court while he is on the bench because he tried to use the system and he took a olth the uphold the law and he used the law to lower his drug alchohol case to get a lower point on his DUI. If hes aloud to deal with any cases that means the law has failed us. He should be held accountable. Police officers lose their job over DUI's he should of lost his as well, or atleast he shouln't be aloud back on the bench until after his case is over but he used the system and its a shame. I dont feel sorry for him but he's aloud to stay on the bench for DUI then nobody has a chance because he could be under the influience at anytime. The Supreme court should get rid of him.

It's a good thing for him he was not driving an old beat up car, and he lives in the Villas! Jail time for sure!

He needs to be held to a higher standard, he does not deserve to sit on the bench anymore. I had to go before him for a speeding ticket and struggle to pay my rent for the month. He gets busted for drunk driving, IN HIS BMW, and then gets to force me to pay the town for going 36 in a 30. If it were me that was caught drunk driving I'd probably be in jail, and it would be his gavel that puts me there.
