Police Charge Villas Woman with Assault by Auto

VILLAS — The Lower Township Police Department on Aug. 13 at approximately 3 p.m. responded to the 100-block of Edna Avenue here on a domestic violence call.

Upon arrival, officers located a male victim who had an injury to his left foot that included abrasions and swelling. In addition, the victim received abrasions to the right side of his torso.

Upon speaking with the victim, it was discovered that a Gina Demalavez, 22, of the 200-block of Village Road came to the residence to pick up their child in common.

As she was preparing to leave the residence on Edna Avenue the victim reached into the vehicle to grab a duffle bag containing the child’s items. At this point the vehicle was put in reverse and accelerated causing the above-described injuries.

Upon receiving this information, Dernalavez was taken into custody at her residence without incident.

She was transported to the Lower Township Police Department for processing.

Judge Birchmeier issued a warrant charging her with assault by auto, release on her own recognizance and no contact with the victim.

Corp. David Fisher, Patrolman Mike Perry, Patrolman Darrin Hickok and Sergeant Thomas Beeby investigated the case.

He was reaching into the car to put the duffle bag on the seat after he buckeled his son into his carseat. She should have been arrested and thrown in jail, after all, it's not the first time she has ***

If she was picking up the child, wouldn't she need the duffle bag containg the child's items? Why did he need them? There is obviously more to this story. Maybe she accelerated because he was reaching in at her. Why isn't he being charged with reaching into the vehicle without her permission? I can't go reaching into someone's car without their permission and expect that if they step on the gas and I get hurt, that they will be charged. Domestic cases are a joke. The laws are different if you were previously in a relationship with this person. It's crazy.

and WHY was he reaching in her car? Its a shame children have to be around such nonsense. Im sure the duffle bag he thought he needed wasnt worth all this
