UPDATED: Vehicular Homicide Charges Pending in Moped Fatality

COURT HOUSE - Charles A. Nailie, 62, of Court House, appeared June 26 before Superior Court Judge Susan Maven here and his attorney, Michael Schreiber, requested a continuance to prepare a bail reduction request.

Schreiber told Judge Maven that his client is on several medications, has diabetes and is suffering from heart ailments.

Matthew Ryan Tozer, 16, was killed June 10 on Route 83 in Dennis Township when a car being driven by Nailie, 62, of Court House, struck Tozer on his moped. Nailie was arrested for driving under the influence and charged with aggravated assault by auto, driving while intoxicated and related vehicle offenses. He is in custody at the county jail in lieu of $100,000 bail.

Prosecutors said Nailie will be charged with the second degree crime of vehicular homicide in the next several weeks.

The matter was continued to July 10, at 9 a.m.

This makes absoulutely no sense.If this man is given a bail reduction, is just further shows the flaws in the courts system.

How can a man who took the life of an innocent young boy on his way to a bible studybegiven a reduction, especially if he is charged with ANOTHER count.

If anything, his bail should be going up.

Most medications state on the bottle... "Do not consume alcohol while taking this medication".. I know that mine does, that's why I won't drink the stuff. His bail should NOT be reduced. There's medical care in jail. Didn't they ever watch "Prison Break"????

I say get rid of cars, if there were no cars there wouldn't be any drunk driving or auto pollution I say ban cars now! oh I forgot that argument only works with guns.Irresponible people commit irresponsible acts

This community needs to rally behind this darkest tragedy and stop the pervasiveness of alcohol in our socieity.

Look at the articles in this month's paper alone. Pay attention to the DUI's, and the underage drinkers. Pay attention to the children NOW. More children died and were injured from alcohol related deaths this month than soldiers in the Iraq war.

Those who drink in their teen years become alcoholics at the highest rate. Parents must pay attention. It is NOT okay to tell your children that it is okay to drink "as long as you drink at home" or "as long as you don't get in a car".

You are grooming an alcoholic when you raise children with that belief. Alcoholism is a physiological illness that is preventable, yet parents turn a blind eye.

Make the life and loss of Matt Tozer grow into the mission and the legend that God intended for this caring young life.

A diabetic knows that certain foods and drink are poison, and can bring on their own death. Among them are the vodka found in his car.

He didn't care enough about his OWN life to treat his alcoholism, and he took another life in the process.

Diabetes, heart disease AND alcoholism make him a poison that should be locked away, just as we keep other harmful poisons locked away. He can be treated in the prison.

Lastly, stating that he has no history of "indictable" offenses is obviously code for he does have a history of offenses. They are probably trying to contaminate a jury pool with his history, so let's keep him from contaminating our community.

RAISE the charges AND the bail.

I am no relation of Mr. Nailie but I really feel all of you who are making these comments should look in the mirror and honestly ask yourselves , Have I ever been drinking and got behind the wheel of a car.? I bet alot of people have done the same thing. I know I have,maybe not at age 62 but when I was younger. Maybe we can all learn a good lesson from Mr. Nailies' unfortunate mistake. I pray for Matts' family as I know they are grieving the loss of their Son and I also pray for Mr. Nailies' family as they must be grieving, because every Son has a Mother and Father. No parent wants to be on either side of this tragedy. I am sure Mr. Nailie did not intentionally set out to kill anyone, especially a child. Pray for everyone concerned and Please Learn a Lesson from this Tragedy.

A young boy died on his moped wearing his helmet following the law. There should be no mercy for a drunk driver, at age 62, who had plenty of time to confront his addiction. I hope the judge increases his bail. He murdered a child with his vehicle while he was drunk. Thats vehicular homicide. May God have mercy on his soul. He has to live with this until the day he dies. My heart goes out to the parents who have lost their child.

Obviously he was not concerned about those medical problems when he was free and drinking. NOW all of a sudden he needs to watch his health. His health problems will be better addressed under strict supervision, wha- la County Jail can supervise. And who is gonna keep him from doing the same thing again? Obviously an alcoholic, driving with an open bottle of vodka in the vehicle. Can't even stop indulging long enough to get from point a to point b? Keep us safe, keep him in lock up.

he took a life not just any life a life of a child that man needs to stay in jail and sober up

While it's a nice thought to believe that "to forgive is divine" the fact remains that a family suffered the loss of an exceptional young man that was robbed of his potential to make a difference in this world. Mixing medication and alchol is a recipe for disastor. This individual's extremely poor judjement killed someone. Why is it he is not being charged with vehicular homicide. Making a conscious decision to mix drugs with alcohol and then taking a life while under the influence makes him guilty of premeditated murder. Mothers Against Drunk Drivers unite!!!!!!!!!!!!!!!!!!!!!!!!!

at least he is alive, who cares about his health problems, they obviously are not that serious if he is drinking.
