COURT HOUSE — Grand jurors April 8 indicted Kyle McClory, a Sea Isle City police officer arrested in September, 2007, who is alleged to have used his urine to help a friend in the city’s public works department pass a drug test.
McClory was indicted on the charges of official misconduct, a second degree crime, defrauding the administration of a drug test, a third degree crime, and conspiracy, a third degree crime.
The indictment accuses McClory of conspiring with Christopher V. Fox on or about June 14, 2007 by providing urine to be used in a drug test. The indictment states McClory, who was 22 at the time, “being a public servant, that is, a police officer, and acting with a purpose to obtain a benefit for another, did commit an act relating to his office but constituting an unauthorized exercise of his official function, knowing that such act was committed in an unauthorized manner,” namely, the act of providing urine to defraud a drug test.
Fox was indicted on the third degree crimes, which carry a penalty of up to five years.
McClory faces as many as 10 years in prison if convicted of the second-degree crime of official misconduct.

BECAUSE PERJURY DOES NOT APPLY. YOU CANNOT JUST CHARGE PEOPLE WITH WHATEVER YOU WANT. READ THE STATUE. YES, THIS OFFICER DID NOT MAKE A GOOD DECISION. BUT I SOUNDS LIKE YOU DO NOT REALLY KNOW WHAT YOU ARE TALKING ABOUT.

Gee, if he would do this, what else could he have done? It is very scary, when a cop breaks the very laws he is sworn to uphold. If he took an oath, then he lied, why not hit him with perjury, and add seven more year's on to his sentence.
